What should I do immediately after a motor-vehicle accident?

Prioritize safety and documentation; Call 911, get medical care, capture the scene, exchange information, notify your insurer, then protect benefits and timelines by involving a lawyer.
Play Button

Can I negotiate with the insurance company on my own?

Yes, but we wouldn’t recommend it, and it could cost you. Insurers respond best when presented with a clear picture of how the injury is affecting you. Successful injury claims hinge on professional experience and a legal / risk analysis that most people aren’t familiar with.
Play Button

Do I need a lawyer right away, or can I wait?

It’s advised to get a lawyer involved early to reduce stress, prevent missteps, ensure insurance claim applications are done correctly. This lets you focus on healing while we handle the insurance and legal matters.
Play Button

Can I still make a claim if I didn’t go to the hospital right after the accident?

Absolutely. Though delays in seeking treatment may cause some complications, it’s not a barrier to a valid claim. Just make sure to start documenting your injuries and impairments.
Play Button

What if the accident was partly my fault?

You can still recover compensation as liability is apportioned between the parties. Do not make any admissions of your potential fault to the other driver or the police. If you are partially at fault, your claim may be reduced.
Play Button

Should I speak to the other driver’s insurance company before speaking to a lawyer?

If they contact you, we recommend you politely decline to discuss the claim and direct them to your lawyer who is adept at preserving your rights and insisting on fair compensation.
Play Button

How long do I have to make a claim after an accident?

The conservative rule is two years, but some individual cases may have a bit more time. So even if you’re just past two years, call a lawyer immediately to see if your case is one that can still be brought.
Play Button

What kind of compensation could I be entitled to?

There are two lanes of recovery; Accident Benefits (no-fault, through your own insurer), and a Tort claim (against the at-fault driver’s insurer). Both address your current income loss and treatment costs. The tort claim also provides compensation for your pain and suffering and accounts for future losses.
Play Button

How long will my case take?

Some cases can take 6 months, others 6 years, depending on the case. Both sides need enough time and medical evidence to know the ongoing impact before talking numbers.
Play Button

Will my case go to court, or can it be settled out of court?

In Ontario, about 97% of personal injury cases settle, so trials are uncommon, typically reserved for complex matters or disputes about who’s at fault. You want to hire a lawyer who knows their way around a courtroom if necessary – that experience gives you a huge advantage.
Play Button

What happens if the at-fault driver doesn’t have insurance?

Ontario policies usually include coverage for uninsured or unidentified drivers, so you may still have a valid claim. Even in a hit and run situation there will likely be coverage.
Play Button

What information and documents should I gather?

Typically, you should gather photo/video evidence of the accident, the other driver’s insurance and contact information, witness contact information, and the police accident report.
